§ 23-1. Vacation of street, alley, public ground.

  • (a)

    When the city council shall deem it advisable to vacate, discontinue, or abolish any street, alley, or public ground, or any part thereof, it shall by resolution so declare and in the same resolution shall appoint a time not less than two (2) weeks thereafter when it will meet and hear objections thereto. Notice of such meeting shall be published once not less than ten (10) days before the time appointed for such meeting in conformance with the city Charter, and notice shall be sent by first class mail to all persons having an interest in the land abutting on any such street, alley, or public ground. Failure to mail such notice shall not invalidate action under this section by the city council.

    (b)

    Objections to such proposed action of the city council may be filed with the city clerk, in writing, and if any such shall be filed, the street, alley, or public ground, or any part thereof, shall not be vacated or discontinued except by a concurring vote of two-thirds of the councilmen elect.
